Applicability.

These terms and conditions apply between you and MartialQuest LLC concerning your purchases of products (“Products”) from martialquest.com (the “Internet Purchase Page”). These terms and conditions shall apply and not be altered without the express written permission from MartialQuest LLC.

Please read these Terms & Conditions carefully before you use our site, as these will apply to your use. We recommend that you print a copy of this for future reference. By using our site, you confirm that you accept these Terms of Use and agree to comply.

If you disagree with these terms of use, you will need to stop using our site.

Sales from the Internet Purchase Page are limited to Customers at least 18 years of age.

Shipping.

The company reserves the right to select alternative carriers for shipments. Shipping charges are invoiced according to UPS, FedEx, or USPS costs. All liability for loss passes to the customer once it leaves our warehouse; however, we will honor replacement merchandise for damaged shipments after the damaged item(s) have been returned. Non-delivery claims will be honored if UPS or USPS offers no proof of delivery; otherwise, merchandise shall be deemed delivered.

Payment terms.

A credit card is the default form of payment that will be accepted for Product orders on the Internet Purchase Page. We use the following methods of payment: Visa, MasterCard, Discover, AMEX, and Apple Pay. All orders received are subject to acceptance by MartialQuest LLC at our sole discretion. All processed orders are subject to availability. MartialQuest LLC is not liable for delay in product shipment.

Sales Tax.

We are required by law to collect all applicable sales tax. The customer authorizes us to add sales tax to any order from a Florida resident at the appropriate sales tax rate.

Time In Transit Damage Claims.

Ownership of each product belongs to you, the Customer, once the package is picked up from our distribution facility by yourself or by any shipping company. We will cover any damage or loss during transit unless damage or loss occurs when a particular carrier selected by the Customer ships the package. Our standard shipping company is United States Postal Service with optional UPS which can be chosen at checkout.

Returns.

We do not accept returns for perishable items; all sales are final. Any claims for misprinted/damaged/defective items must be submitted within 14 days after receiving the product. For packages lost in transit, all claims must be presented at most 14 days after the estimated delivery date.  All sales for limited edition / limited quantity items are FINAL unless there is a product defect.  Please get in touch with us via our contact page before returning your items.  The customer must pay shipping for authorized returns.

Defective merchandise will be exchanged for the same or similar product. Refunds are not given for any claims.

Limitation of Damages & Liability.

MartialQuest LLC is in no way liable to any Customer or Subscriber for any special, incidental, consequential, or punitive damages or any claim by any third party. The customer agrees that for any liability related to the purchase of any products, MartialQuest LLC is not liable for any damages above the aggregate dollar amount paid by the customer for the purchases under this agreement.

Linking to our site.

You can link to our home page if you do it in a way that is fair and legal and does not damage our reputation or take advantage of it.

You'll need to avoid establishing a link in such a way as to suggest any form of association, approval, or endorsement on our part where none exists.

You must not establish a link to our site on any website that you do not own.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

We reserve the right to withdraw linking permission without notice.

We reserve the right to adjust pricing on products without notice. In addition, we reserve the right to modifyations, terms, specifics, and the like for Products on the Internet Purchase Page or Website at any time without notice. Any errors in Product specifications, descriptions, and pricing are subject to our correction. We also reserve the right to reject any order inconsistent with these terms & conditions or our sales policy guidelines.
